In practice it is most often used by programmers running a JDG (sole proprietorship) who sell proprietary copyright to code to a client. The relief, however, is not available to everyone — it requires creative activity, separate records and the nexus ratio.

What IP Box relief is

The preference arises from Article 30ca of the PIT Act (and Article 24d of the CIT Act, correspondingly) and has been in force since 2019. The base for the 5% rate is qualified income, that is income from so-called qualified IP earned in the tax year and multiplied by the nexus ratio. The list of qualified rights is closed and covers, among others:

patents, protection rights for utility models, rights to registered industrial designs,

supplementary protection rights for medicinal products or plant protection products,

rights to registered integrated-circuit topographies,

copyright to a computer program — the category most often used by the IT industry.

The right must be protected under Polish law or international agreements (e.g. the Berne Convention), and the subject of protection must be created as a result of the taxpayer's R&D activity — that is, scientific research or development work within the meaning of the Act on Higher Education and Science.

Conditions a programmer must meet

To apply the 5% rate to income from copyright to a computer program, the entrepreneur should jointly meet the following conditions:

Carry out R&D activity — creatively and systematically, increasing the stock of knowledge and creating new applications. The income is multiplied by the nexus ratio, which reflects the share of the taxpayer's own R&D work in the costs of creating the right. The formula is:

nexus = ((a + b) × 1.3) / (a + b + c + d), where:

a — the taxpayer's own R&D costs related to that IP,

b — costs of acquiring R&D results from an unrelated entity,

c — costs of acquiring R&D results from a related entity,

d — costs of acquiring the qualified IP itself.

The ratio cannot exceed 1. They should isolate each program-work, assign to it revenue, direct and indirect costs (allocation key), as well as the data needed for the nexus ratio. The project documentation should ideally include:

a description of the R&D work carried out (hypothesis, iterations, result),

code fragments, the repository, commits, technical documentation,

contracts with counterparties in which the transfer of proprietary copyright is clearly indicated,

invoices showing the remuneration for the transfer of rights as a separate item.

The absence of separate records rules out using the relief — even if all the other conditions are met.

Individual tax ruling — is it mandatory

The regulations do not require the taxpayer to obtain an individual tax ruling from the Director of National Tax Information (KIS) before applying IP Box. In practice, however, many entrepreneurs apply for one — first, to have official confirmation that their work meets the definition of R&D, and second, to be protected against a dispute during an inspection. The fee for one event is PLN 40 and the standard waiting time is about three months. The ruling is only protective for the exact facts described in the application; every essential element of the work must be described in it precisely.

How to settle IP Box in the 2026 PIT return

The relief is claimed after the end of the year, in the annual return.
