Joint filing of spouses means that the tax is calculated on half of the couple's combined income and the result is multiplied by two. The benefit arises when the spouses' incomes differ clearly, especially when one exceeds the PLN 120,000 threshold and the other earns little or nothing. With similar earnings, the tax comes out the same as with separate filing.
Who can file jointly
The rules follow from Article 6 of the Personal Income Tax Act. As a rule each spouse files individually, but joint taxation is possible when the following conditions are met jointly:
- both have unlimited tax liability in Poland (are Polish tax residents);
- throughout the tax year they remained in marriage and in the matrimonial community of property, and if the wedding took place during the year — from the wedding day to 31 December;
- neither of them settles business income in the given year with the flat tax (podatek liniowy) or ryczałt from recorded revenue;
- the request is expressed in the annual return.
Joint filing is also available when one of the spouses had no income taxed on the scale at all or earned so little that no tax would be due. The request may be filed by one of the spouses; the Act treats this as a statement of authorisation by the other spouse, filed under criminal liability.
What rules out joint filing
The most common obstacles in practice are:
- flat tax or ryczałt in one spouse's business; the exception is ryczałt on private rental, which does not block joint filing;
- separation of property established by agreement or court judgment before the end of the year, or legal separation;
- divorce granted in a final judgment during the year, because the marriage no longer existed for the whole year;
- taxation under the tonnage tax.
The application of IP Box is not listed among the exclusions, so a programmer settling qualified income at 5% does not for that reason lose the right to joint filing of the remaining income taxed on the scale.
How much can be gained: two examples
Large income difference
In 2026 Mr Adam earned PLN 200,000 of income from employment and business activity on general rules. His wife spent most of the year caring for the child and earned PLN 20,000.
| Variant | Calculation | Tax |
|---|---|---|
| Separately: Mr Adam | 12% × PLN 120,000 + 32% × PLN 80,000 − PLN 3,600 | PLN 36,400 |
| Separately: wife | income below the PLN 30,000 tax-free amount | PLN 0 |
| Jointly | (12% × PLN 110,000 − PLN 3,600) × 2 | PLN 19,200 |
The difference is PLN 17,200. Joint filing moves part of Mr Adam's income into the lower bracket and allows the wife's tax-free amount to be used.
Similar incomes
If one spouse has PLN 90,000 of income and the other PLN 70,000, both fit in the 12% bracket. Separately they will pay PLN 7,200 and PLN 4,800, together PLN 12,000. Jointly: half of the sum is PLN 80,000, tax (12% × PLN 80,000 − PLN 3,600) × 2 = PLN 12,000. The result is identical, so joint filing changes nothing, though it does no harm either.
Business on flat tax or ryczałt: is it worth changing the form
An entrepreneur on the flat tax or ryczałt cannot file jointly with a spouse for that year. However, a switch to the scale from the next year can be analysed. The calculation covers not only PIT but also the health contribution, which is 9% of income on the scale and 4.9% under the flat tax. In families where one spouse is not working professionally and the business income is not very high, the scale combined with joint filing is often more favourable than the 19% rate. For high incomes the flat tax usually wins. The deadlines for changing the form are described in the article on changing the form of taxation of JDG.
Special situations
- Death of a spouse: a widow or widower may file jointly if the spouse died during the year or after it ended but before the return was filed, and the community of property existed.
- Spouse living in another EU or EEA country or in Switzerland: joint filing is possible if income taxed in Poland is at least 75% of the couple's combined income and residence is confirmed by a certificate of tax residence.
- Spouse from outside Europe: the rules on joint taxation of non-residents cover only EU, EEA and Switzerland, so with residence outside them joint filing is usually not available.
How to file jointly
- Gather both spouses' annual information (PIT-11, PIT-40A and others) and data on business income on the scale.
- Choose the return: PIT-37 if neither spouse runs a business, or PIT-36 if either has business income on the scale or foreign income.
- Mark in the return the request for joint taxation and enter data for both spouses.
- Reliefs deducted from income, e.g. the internet relief, are reported separately by each spouse in their part of the return.
- File the return in the period from 15 February to 30 April 2027 for 2026, e.g. in the Twój e-PIT service.
A joint return is signed once, and the tax is assessed in the name of both spouses, which means both are liable for its payment.
How Good Balance can help
We compare filing variants for the whole family, including the effect of the firm's form of taxation and the health contribution, and prepare the return. In unusual situations, e.g. a spouse resident abroad, we help obtain a tax interpretation. We run the firm's settlements on the scale as part of simplified accounting.
